ORAL ORDER (PER : HONOURABLE MR. JUSTICE ILESH J. VORA)
1. In this matter, the marriage of the parties dissolved by the Family Court by mutual consent and so far custody of the minor son is concerned, it was agreed between the parties that, permanent custody of the son shall remain with the wife. On the basis of visitation right granted in favour of the husband, the child was with him since 15th April, 2026. As a result, the present petition being filed for issuance of necessary direction with respect to custody of the child.
2. During the pendency of this application, it has been agreed between the parties that let the custody of the child be remained with the husband and visitation right being conferred upon the wife, as agreed at the place and time, as per the mutual

3. Today, in the presence of counsel of the respective parties including the child, the parties have agreed mutually about the custody of the child and visitation rights as referred in para-2 of this order.
4. In such circumstances, reserving liberty to file fresh petition in case of any difficulty, the petition stands disposed of accordingly. The court has not gone into the entitlement of custody of the child. It is open for the parties to raise the issue of custody by filing fresh petition. Notice discharged.
