ORAL ORDER
Heard learned counsel for the petitioner and learned counsel for the respondents.
2. The petitioner has filed this petition under Sections 397 and 401 of the Code of Criminal Procedure, 1973, to set aside the impugned order dated 12.06.2026 passed by the learned Principal City Civil and Sessions Judge, Bengaluru, in Crl.Misc.No.5039/2026 and to restore the case to its respective Court, i.e., C.C.No.70956/2024 to the Court of the XXIX Additional Chief Judicial Magistrate, Bengaluru.
3. The operative portion of the order reads as under:
“The petition filed under Section 408 of the Cr.P.C. is allowed. C.C.No.70956/2024 pending on the file of the XXIX ACJM, Bengaluru, is withdrawn and made over to the Court of MMTC- VI, Bengaluru, wherein Crl.Misc.No.135/2024 is pending, for disposal in accordance with law. Send a copy of the order to the concerned Courts forthwith, for information and necessary further action.”
4. In this case, the relationship between the parties is not disputed and the fact that the petitioner is the wife of respondent No.2 and respondent Nos.3 and 4 are the father

and brother of respondent No.2 is also not disputed. Since both the cases were pending before two different Courts, the learned Principal City Civil and Sessions Judge, Bengaluru, has passed the impugned order withdrawing C.C.No.70956/2024 pending on the file of the XXIX ACJM, Bengaluru, and making over the same to the Court of MMTC-VI, Bengaluru, wherein Crl.Misc.No.135/2024 is pending for disposal.
5. Since both the Courts are located in Bengaluru City, the order passed by the learned Principal City Civil and Sessions Judge, Bengaluru, does not cause any prejudice to the parties. Hence, there is no merit in the petition. Accordingly, the Criminal Revision Petition is dismissed.
6. The Trial Court is directed to expedite the matter without granting unnecessary adjournments.
