1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.378/2025 registered at Police Station – Kasdol, District: Baloda Bazar-Bhatapara, C.G. for the offence punishable under Sections 318(4), 316(5), 318(3) and 111 3(5) of Bhartiya Nyay Sanhita, 2023. 2. 2 with other accused has received the amount Rs. 40,82,000/- from the complainant and gave the assurance that he will invest the amount in the Share Market and the amount will be doubled within 02 years. That on the assurance of the accused Ramnarayan Sahu, the complainant has received the amount from his family members and gave it to the accused Ramnarayan Sahu but he failed to return the amount and the main accused Ramnarayan Sahu has committed fraud with him ii. That on the complaint of the complainant P.S. Kasdol registered the Crime No. 378/2025 for the alleged offence punishable U/s 420 and 34 of I.P.C. against the main accused Ramnaranyan Sahu and another and after investigation filed the charge sheet against them for the offence punishable U/s 316 (5), 318 (4), 318 (3), 3 (5) and 111 of BNS. That presently P.S. Kasdol has sent the notice to the present applicant regarding his involvement in the alleged crime, despite the fact that the applicant has not committed any offence as alleged against him, that the applicant is victim/ investor and he has also paid amount Rs. 55,16,100/- in installment between 02.09.2023 to 20.09.2024 to the main accused Ramnarayan Sahu and other co- accused, that after knowledge of the fraud with the present applicant, the applicant demanded his money return back then the co-accused Ramnarayan Sahu given the assurance that he will return the entire amount within short time, but he was arrested in present crime number and falsely implicated the present applicant by making statement, against him in his memorandum statement. That the applicant has taken a loan and then given the said amount to the main accused Ramnarayan Sahu.
That the applicant is also a victim, but he has been falsely implicated in the alleged crime only on the basis of memorandum of co-accused Ramnarayan Sahu and he has not committed any fraud with the
3 complainant Gopal Prasad Dewangan. That the police authority has already completed the investigation against the main accused Ramnarayan Sahu and filed the charge sheet against him. 3.
Learned counsel for the applicant submitted applicant is innocent and has falsely been implicated in the present case. He further contended that co-accused, namely Ranu Dhrw has preferred anticipatory bail application bearing MCRCA No.228/2026, which was allowed by this court on 12.02.2026, therefore, he submits that the present applicant is also entitled to be released on anticipatory bail on the ground of parity.

On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail to the applicant and submits that applicant has four criminal antecedent and all mentioned in the bail application at paragraph No.4(a) in the bail application, and she could not disputed the fact that namely Ranu Dhrw has preferred anticipatory bail application bearing MCRCA No.228/2026, which was allowed by this court on
12.02.2026.
5. I have heard learned counsel for the parties and perused the materials available on record.
6. Considering the facts & circumstances of the case, submission of
learned counsel for the parties, materials available on record, considering the fact that Ranu Dhrw has preferred anticipatory bail application bearing MCRCA No.228/2026, which was allowed by this court on 12.02.2026, therefore, I am inclined to grant anticipatory bail to the present applicant on the ground of parity.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Dharanidhar Patel, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) The applicant shall not involve himself in any offence of similar nature in future. Sd/- (Ramesh Sinha)
