This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.68/2026 registered at Police Station – Champa, District: Janjgir- Champa, C.G. for the offence punishable under Sections 296, 351(3), 115(2), 119(1), 3(5) of Bhartiya Nyay Sanhita, 2023. 2. Case of the prosecution, in brief, is that the complainant lodged FIR against the applicant on 19.02.2026 at 20:35 O'clock and stated that the quarrel between applicant & complainant and other friends of the VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.04.10 18:31:54 +0530 2 applicant, because on 18.02.2026 at 8:30 PM, the complainant and his friend Dhananjay Bareth and Bajrang Yadav going to liquor shop and after purchasing the liquor, they are reverse back his car bearing Registration No. CG 11 AR 4352, on that time complainant's bike (Bullet) touched with the car. On that matter, the applicant's complainant and applicant started quarrel and the applicant man handed him. 3. Learned counsel for the applicant submitted that applicant is innocent and has falsely been implicated in the present case. He further contended that on the date of incident there was quarrel took place between the applicant and complainant regarding parking of the car and also compromise was done between the parties but after 24 hours FIR has been lodged by the complainant, therefore, he submits that the present applicant is also entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail to the applicant and submits that applicant has two criminal antecedents of the year 2022 for the offence under Section 323. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, also considering the fact that there was simple quarrel took place between the parties regarding parking of the car and also compromise was done between the parties on the spot, but after 24 hours FIR has 3 been lodged by the complainant therefore, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Manav Sharma, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
