The Court made the following ORDER:
The present revision petition has been filed under Article 227 of the Constitution of India. The grievance of the petitioner / plaintiff in O.S.No.142 of 2022, on the file of the Court of Junior Civil Judge, Vayalpad, is that the said I.A. is not being taken up for disposal. 2) Learned counsel for the petitioner, inter alia submits that the petitioner filed the said suit seeking permanent injunction restraining the defendants, their men, agents etc., from interfering with the plaintiff’s peaceful possession and enjoyment of the plaint schedule property.
He submits that along with the said suit, petitioner / plaintiff filed I.A.No.390 of 2022, under Order 39 Rule 1 and 2 of CPC seeking temporary injunction, that the learned trial Court granted temporary injunction by an order dated 20.05.2022. He also submits that as the respondents / defendants have committed breach of the orders passed in I.A.No.390 of 2022, petitioner / plaintiff was constrained to file I.A.No.780 of 2024 under Order 39 Rule 2A and Section 151 of CPC, to punish the defendants. He submits that though about one and half years elapsed, the said application is not decided so far and the matter is being adjourned from time to time at the behest of the respondents / defendants. He submits that under the said circumstances he seeks appropriate direction for disposal of I.A.No.780 of 2024. 3) This Court has considered the submissions made and perused the material on record. As submitted by the learned counsel for the petitioner,

I.A.No.780 of 2024 is being adjourned from time to time for filing counter. Now the matter stands posted to 01.07.2026. 4) In the light of the above stated position, this Court is inclined to dispose of the revision petition, providing that the learned Trial Court shall make an endeavour to dispose of I.A.No.780 of 2024, after giving opportunity to both the parties in accordance with law, as expeditiously as possible, within a period of four (04) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not examined the matter with reference to the merits or otherwise of stand of the parties to the lis.
