APP Ms. Priti Kar Bagchi … for the State-respondent(s) Learned advocate for the petitioner submits that there has been change of circumstances as one Hare Krishna Roy has been granted bail in the present case. The petitioner happens to be the owner of one of the trucks. It has been claimed that the petitioner had by an agreement handed over the truck to the transporter. Consequently, he had no control over the truck or its business. Learned advocate for the State opposes the prayer for bail and submits that 19,400 bottles of phensedyl were recovered in the present case and so far as the present petitioner is concerned, at the relevant point of time, he is found to have been in communication with one of the 2 accused. There are CDR to that effect. Additionally, there has been money trial available between the petitioner and another accused. Having considered the huge quantum of recovery made in the present case and taking into account the complicity of the present petitioner, at this stage, I am not inclined to grant bail to the present petitioner. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 1755 of 2026 is dismissed. Pending application(s), if any, is also disposed of.
