This civil writ petition has been filed under Article 226 of the Constitution of India seeking issuance of a writ in the nature of Certiorari for quashing the impugned Office Memorandum dated 08.05.2023 (Annexure P-11), particularly Para 5(1) thereof, whereby 28.10.2005 has been prescribed as the cut-off date for determining the eligibility of the petitioners for coverage under the Old Pension Scheme, being allegedly illegal, unconstitutional, arbitrary and having no nexus with the object sought to be achieved, besides being contrary to the basic spirit of the Office Memorandum dated 03.03.2023 issued by the Government of India (Annexure P-10), which has been adopted mutatis mutandis by the respondent-State. Further, a writ in the nature of Mandamus has been sought PARUL VERMA 2026.08.14 10:41 I attest the accuracy and authenticity of this order/judgment directing the respondents to extend the benefit of the Office Memorandum dated 08.05.2023 to the petitioners, as they were appointed against posts/vacancies which had been advertised/notified prior to the notification introducing the New Defined Contributory Pension Scheme, i.e. 28.10.2005, and to consider their claim for coverage under the Old Pension Scheme by treating 18.08.2008, i.e. the date of promulgation of the New Defined Contributory Pension Scheme (Annexure P-7), as the relevant cut-off date instead of 28.10.2005, along with all consequential benefits.
