M/L- 1059 25/08/2026 Ct. No.- 6 Aritra C.O. 1467 of 2026
Ashok Kumar Kar Vs. Anup Maity
This matter was mentioned by the learned advocate for the petitioner citing urgency. Considering the urgency pleaded this matter has been upgraded. When this matter was called on for hearing, none appears for the petitioner, no accommodation has been sought for either. This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.) at Kakdwip, District-South 24-Parganas to dispose of the Title Suit No.432 of 2017 and the Misc. Case No.10 of 2025 expeditiously. From the order sheets appended to this application, this Court finds that an ex parte decree in Title Suit No.432 of 2017 has been passed on April 2, 2025. From the order sheets appended to this civil revisional application in Misc. Case No.10 of 2025, this Court finds that a date has been fixed for service returns and acknowledgement due. It appears that the misc. case is not yet ready for hearing. For such reason, this Court is not inclined to pass any direction for expeditious hearing at this stage. With the above observations, CO 1467 of 2026 stands disposed of.
