25.08.2026 Serial no. 774 [G.S.Das] Assistant Registrar (Court) CRM (NDPS) 1756 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with New Township PS Case No. 59 of 2025 dated 01.05.2025 u/s 20(b)(ii)(c)/29 of the NDPS Act [NDPS Case No. 16 of 2025]. -And- In the matter of : Jagadish Roy … Petitioner(s) Mr. Gaurav Dutta Mr. Srinjan Ghosh … for the Petitioner(s) Mr. Rajdeep Biswas Ms. Deblina Bhattacharjee … for the State-respondent(s) Learned advocate for the petitioner submits that inspite of the direction passed by this court on 09.04.2026, the seizure list witnesses have not been examined. I have taken into account the materials available in the case diary which involves 73.715 kg of ganja. Having considered the quantum of recovery in the present case and the fact that there has been no change of circumstances, at this stage, I am not inclined to release the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. 2 However, the learned trial court would ensure that the seizure list witnesses are examined at the earliest. To that effect, priority be given to the said witnesses. Accordingly, CRM (NDPS) 1756 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
