1. Momo of Evidence filed in Court be taken on record. 2. Upon hearing the learned advocate appearing for the petitioner as well as learned advocate for the State and on perusal of the materials in the case diary, it transpires that the petitioner is said to have committed rape upon the victim after dragging her to an adjacent area of her house. The victim has refused her medical examination. On perusal of the statements of the victim recorded under Section 183 of BNSS, 2023 and statements of witnesses recorded under Section 180 of BNSS, 2023, there appears that there were disputes between the complainant party as well as the petitioner. When the victim went near the garden of the
2 present petitioner, she was dragged to a lonely place and rape was committed upon her. As noted above, de facto complainant has refused medical examination. 3. Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. 4.
Accordingly, I direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that the petitioner shall report before the Investigating Officer once in a fortnight till the conclusion of the investigation and on further condition that the petitioner shall appear on every date before the jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court. 5. Prayer for anticipatory bail of the petitioner is allowed. 6. CRM (A)/2490/2026 is disposed of. (Md. Shabbar Rashidi, J.)
