By this petition filed u/s 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner prays for modification of the order dated 19.12.2025 passed in Complaint Case No. 1632/2016 whereby the learned trial Court convicted the petitioner and sentenced to undergo SI of 1 year and to pay a compensation of Rs.19,33,000/- to the complainant with further default stipulation. 2. Learned counsel for the petitioner submits that the petitioner has ALLENA ANNAJEE RAO Digitally signed by ALLENA ANNAJEE RAO Date: 2026.04.07 15:42:44 +0530 2 preferred appeal before the appellate Court against the said order of conviction placed by the JMFC for the offence under section 138 of the Negotiable Instruments Act. He submits that the amount of fine/ compensation imposed by the trial Court has not been deposited by the petitioner as he is a partner of the partnership firm which is having a collective entity and the petitioner is praying for rectification of the order passed by the trial Court before this Court. 3. Since according to the learned counsel appeal has been preferred, I am not inclined to issue the direction as prayed in this petition. The petitioner, if so desires, may make such prayer or raise the grounds/points before the appellate Court, which have been raised in this petition filed before this Court. 4.
