Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 7 months and the subject matter of the case relates to alleged recovery of 62 bottles of Codeine Phosphate. Charge-sheet has already been submitted. Learned advocate for the State opposes the prayer for bail. I have taken into account the fact that there are no previous antecedents of the present petitioner and the prosecution in the charge-sheet has relied up 7 witnesses in order to prove its case. Having considered the overall circumstances, I am inclined to release the petitioner on bail. As such, the prayer for bail 2 of the petitioner is allowed. Accordingly, the petitioner, namely, Golam Mostafa shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, under NDPS Act, 3rd Court, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned special court. Thus, CRM(NDPS) 1752 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
