The Court made the following: ORDER:
This Interlocutory Application is filed seeking condonation of the delay of 556 days in filing the present Criminal Revision Case. 2. Heard the learned counsel for the petitioner, the learned counsel appearing for respondent Nos.1 to 4, and the learned Additional Public Prosecutor. 3.
The petitioner preferred the present Criminal Revision Case challenging the judgment in C.C. No.146 of 2011 on the file of the Special Magistrate Court, Alamuru, East Godavari District, whereby the respondents were acquitted under Section 248 of the Code of Criminal Procedure, 1973 (for brevity, “the Cr.P.C.”) of the offence punishable under Section 498-A of the Indian Penal Code, 1860 (for brevity, “the IPC”). The appeal preferred against the said judgment was dismissed, confirming the judgment of the learned Magistrate. 4. In the affidavit filed in support of the application, the petitioner stated that she suffered from jaundice and was also facing financial difficulties. It is further stated that, after recovering from her illness, she approached her counsel and filed the present Criminal Revision Case. 5. Admittedly, no document has been filed along with the application to establish that the petitioner was suffering from jaundice. No medical certificate has been produced in support of the said plea. Further, the petitioner has not even specified the period during which she allegedly suffered from jaundice. Except making a bald assertion, no material has been placed before this Court to substantiate the said contention. The delay involved is 556 days, which is more than eighteen months. In the absence of any satisfactory explanation or material establishing sufficient cause for condoning the delay, this Court is not inclined to exercise its discretion in favour of the petitioner. Accordingly, I.A. No.1 of 2019 is dismissed. Consequently, the Criminal Revision Case is dismissed. As a sequel, miscellaneous petitions, if any, pending in this Criminal Revision Case shall stand closed. There shall be no order as to costs. _________________________ DR. Y.
