3. Vide order dated 29.08.2025 of this Court, despite repeated calls, no one appeared on behalf of the Petitioner, therefore, this Court has dismissed ACQA No. 337/2024 for want of prosecution.
4. Learned counsel appearing for the petitioner submits that the counsel previously engaged by the petitioner had shifted to her matrimonial home and had ceased practising at Bilaspur, without informing the petitioner about the listing of the matter SOURABH PATEL Digitally signed by SOURABH PATEL Date: 2026.09.18 14:21:32 +0530
2 or its subsequent dismissal. He further submits that the petitioner's absence was neither deliberate nor intentional, but was occasioned by bona fide reasons beyond the petitioner's control.
5. Taking into consideration the submission made by learned counsel for the petitioner and cause shown in the application, I am inclined to restore ACQA No.337/2024.
6. Prayer for restoration of the acquittal appeal is allowed and ACQA No. 337/2024 is restored to its original number subject to the petitioner depositing cost of Rs.1,000/- within seven days from today to the High Court Legal Services Authority.
7. Accordingly, the CRMP is disposed of. Sd/-
