Mr. Benazir Shaikh Mr. Ibrahim Shaikh ….for the petitioners Ms. Pampa Dey (Dhabal) Mr. Tanmoy Mukherjee Mr. Biswaroop Chatterjee ….for the opposite parties The learned advocate appearing for the petitioners submits that though in the civil revisional application the order dated April 10, 2026 passed by the learned Civil Judge (Jr. Div.), 6th Court at Alipore in Title Suit No.441 of 2026 has been challenged but he has been instructed by the petitioners not to press such challenge at this stage. He submits that he has been instructed by the petitioners only to pray for a direction upon the learned trial judge to dispose of the pending injunction application expeditiously. The opposite parties are represented by their learned advocates. It is not in dispute that the application under Order XXXIX Rule 1 and 2 of the Code of the Civil Procedure is pending. The said application is otherwise ready for hearing. In the light of the submissions made by the learned advocates for the respective parties, CO 1726 of 2026 stands disposed of by requesting the learned Civil Judge (Jr. Div.), 6th Court at Alipore to take up the hearing of the 2 application under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure on the next date fixed, if the same is otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible but preferably within a period of 12 weeks from the next date fixed without granting any unnecessary adjournments to either of the parties. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
