1. Heard learned counsel for the petitioner and Mr. M.P. Goswami, learned APP, Assam.
2. Scanned copy of the TCR as called for has been received.
3. The allegation as per the FIR is that the present petitioner was in a love affair with the daughter of the informant and certain misunderstanding and altercation
Page No.# 2/2 had arisen between both sides, which were, however, settled. Subsequently, on 18/12/2025, when the daughter of the informant was married to another person, the accused entered into the premises and assaulted her and caused grievous injuries.
4. As per the Medico Legal Report, the victim sustained lacerated wound on her forearm as well as fracture on the right and injuries on her back.
5. The petitioner was arrested on 21/12/2025 and by now has spent 93 days behind the bars.
6. Having regard to the fact that charge sheet has already been submitted as well as the aforesaid period of detention. As such, further detention of the petitioner is not necessary. Accordingly, the prayer for bail is allowed.
7. The petitioner viz. Rashidul Islam shall be released on bail on furnishing a bond of Rs. 50,000/- with 2 (two) local sureties to the satisfaction of the Ld. Sub- Divisional Judicial Magistrate (M), Gossaigaon.
8. The petitioner shall participate in the trial and shall not try to intimidate the witnesses.
9. The bail application is accordingly disposed of.
