Mr. Priyankar Gnguly

….for the State.
Learned Senior Advocate appearing for the petitioner submits that although the subject matter of the case relate to alleged recovery of 500 Gms. of Brown Sugar but petitioner has been implicated only on the basis of statement of the co- accused.
Learned advocate for the State opposes the prayer for anticipatory bail.
This Court specifically asked regarding the materials available so far as previous antecedents, CDR or money trail in
2 respect of the accused. Categorically, it has been represented such materials are not available in the report or in the case diary.
Having considered that the only material available against the petitioner is, statement of co-accused, I am inclined to allow the prayer for anticipatory bail of the petitioner. As such, I direct that in the event of arrest, the petitioner namely, Rahamat Sk @ Md. Rahamatulla Sk be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
