2. According to petitioner, her husband passed away on 20.10.2003, while serving as Sweeper in Nagar Palika Parishad, Haldwani- Kathgodam. She further submits that she has not been paid family pension, therefore she has approached this Court seeking a direction to the competent authority to release the pension.
3. Mr. Ashish Joshi, learned counsel appearing for Municipal Corporation, Haldwani expressed surprise on the plea taken by petitioner. He submits that it is not possible that family pension is not being released to the widow of a deceased regular employee.
4. He assures that if petitioner makes representation to the competent authority within 10 days, decision thereupon shall be taken by the Municipal Commissioner, as per law within four weeks thereafter.
5. Accordingly, the writ petition is disposed of by permitting petitioner to make
