During hearing, Mr. Bhaskar Deb, learned counsel, submits that he is not pressing the bail application. However, learned counsel submits that the accused persons have been in custody since the date of their arrest on 09.09.2025. Therefore, a direction may be given to the learned Trial Court to expedite the trial and to dispose it in a time bound manner. In view of the above said submission, the learned Trial Court is directed to expedite the trial considering the fact of incarceration of the accused persons. All endeavour will be taken from the side of prosecution to ensure attendance of the witnesses on the dates fixed, on a regular basis before the learned Trial Court unless any witness(s) is/are incapacitated to attend on the date(s) fixed for any special reason. The learned Trial Court will also look into the matter that whenever despite proper explanation any witness is not appearing to depose without reasonable cause and causing delay in trial, any coercive action may be taken against the concerned witness, by the learned Trial Court, as per law. Communicate a copy of this order to the learned Trial Court immediately. Bail application is accordingly disposed of.
