Mr. Rakib Hossain Khan ….for the petitioner This application under Article 227 of the Constitution of India is at the instance of the applicant in a proceeding under Act 39 Case No.16 of 2023 praying for a direction upon the learned District Judge, Hooghly at Chinsurah to dispose of the said proceeding expeditiously. From the order sheets appended to this application, this Court finds that September 9, 2026 is fixed for hearing on the point of maintainability. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 2847 of 2026 stands disposed of by requesting the learned District Judge, Hooghly at Chinsurah to take up the hearing on the point of maintainability on the next date fixed i.e., on September 9, 2026 and decide such issue as expeditiously as possible but preferably within a period of 12 weeks from the next 2 date fixed without granting any unnecessary adjournments to either of the parties. After disposal of the said issue, the learned District Judge shall proceed in accordance with law and dispose of the Act 39 Case No.16 of 2023 as expeditiously as possible. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
