Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 1 month. Charge-sheet has been submitted. Charges have been framed and only one witness out of 13 witnesses cited by the prosecution has been examined.
State has opposed the prayer for bail and referred to the injury report as well as the statement of the victim under Section 183 of the BNSS.
I have taken into account the overall materials appearing in the case diary, prima facie, an offence has been made out. However, the petitioner is a lady. There are no previous antecedents
2 and that the trial will take some time to be taken to its logical conclusion. Having considered the same, I am of the view that the petitioner should be released on bail. As such, the prayer for bail of the petitioner is allowed.
Accordingly, the petitioner, namely, Anisa Das shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Alipore. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the districts of Kolkata and 24 Parganas (South) without prior permission of the learned trial court.
Thus, CRM(M)1470 of 2026 is allowed.
