Accused No.1 in Crime No.151/2013 registered by the Yelahanka New Town Police Station, Bangalore City, for the offence punishable under Section 392 of IPC, 1860, is before this Court in this petition filed under Section 483 of the BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. A perusal of the material on record would go to show that the petitioner, who was arrested in the present case at the trial stage on 20.06.2013 was subsequently released on bail. After completion of investigation, charge sheet is filed against 4 persons for the aforesaid offence and the petitioner is arraigned as accused No.1 in the charge sheet. It appears that during the course of trial in the present case in SC No.1132/2017 the petitioner absented himself before the Sessions Court and therefore, a split up case was registered him in SC - 3 - HC-KAR CNR: KAHC010502322026 NC: 2026:KHC:45487 CRL.P No. 10935 of 2026 No.471/2022. In the said case, he was produced under a body warrant before the Sessions Court on 18.02.2026 and remanded to judicial custody. His bail application filed thereafter before the Sessions Court was rejected and therefore, he is before this Court. 4. Learned counsel for the petitioner has brought to the notice of this Court that the other accused who were tried in SC No.1132/2017 for the charge sheeted offence in the present case were acquitted by the Sessions Court vide judgment and order of acquittal dated 13.07.2022. 5. The petitioner who was granted regular bail on merits in the present case is now arrested and remanded to judicial custody for the reason that he has not appeared before the Sessions Court on regular basis. He has now undertaken before this Court that he shall cooperate before the Sessions Court for speedy disposal of the case. For the mistake committed by the petitioner he has been sufficiently punished. The petitioner who was earlier granted regular bail is in custody for the last 6 months. It is brought to the notice of this Court that the petitioner in the present case has no other criminal - 4 - HC-KAR CNR: KAHC010502322026 NC: 2026:KHC:45487 CRL.P No. 10935 of 2026 antecedents. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. 6. Accordingly, the following: ORDER The criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.151/2013 registered by the Yelahanka New Town Police Station, Bangalore City, for the offence punishable under Section 392 of IPC, 1860, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioner shall appear before Yalahanka New Town Police Station on every 3rd Sunday of - 5 - HC-KAR CNR: KAHC010502322026 NC: 2026:KHC:45487 CRL.P No. 10935 of 2026 the month between 10 a.m., and 2 pm., and mark his attendance regularly for a period of one year from the date of his release from custody; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
