Petitioner, in this writ petition, prays for the following reliefs :- “10.1 That, the Hon’ble Court may kindly be pleased to issue a writ of mandamus or any other appropriate writ, order or direction, quashing and setting aside the impugned order dated 13-8-2026 bearing No. 3351/निनिदा/1716 (Annexure P-9), passed by Respondent No. 2, whereby the work orders pertaining to Tender No. 63/4079 dated 18.02.2026 was cancelled, in the interest of justice; 10.2 That, the Hon'ble Court may kindly be pleased to issue a Writ of Mandamus or any other appropriate writ, order or direction, commanding Respondents to forthwith supply to the Petitioner the list of CSPDCL approved vendors and the requisite drawings in respect of the aforesaid two works, in the interest of justice; 10.3 That, the Hon'ble Court may kindly be pleased to issue a Writ of Mandamus or any other appropriate writ, order or direction, directing Respondents to restore/revive 3 the aforesaid two work orders in favour of the Petitioner and to grant the Petitioner a reasonable extended period, commensurate with the delay attributable to Respondents, for completion of the said works, in the interest of justice; 10.4 Award costs of the present petition to the petitioner, in the interest of justice; 10.5 Pass such other and further order(s) as this Hon'ble Court may deem just, fit and proper in the facts and circumstances of the present case, in the interest of justice. 2. The petitioner has also filed an application for interim relief. Since the cause of action arises out of an agreement and the Clause No. 17 of the Agreement indicates that, the dispute which would arise from the said agreement, would be amenable to the arbitration, therefore, learned counsel for the petitioner prays for withdrawal of this writ petition to avail the remedy under the Arbitration and Conciliation Act, 1996 (for brevity, ‘the Arbitration Act’) 3. Accordingly, the writ petition is disposed of as withdrawn. The petitioner, if so advised, may also seek remedy under the Arbitration Act. It may also seek for any interim relief in terms of the Arbitration Act.
