THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner who is the wife of the detenu Ramu (CTP No.6961) is before this Court seeking for the following reliefs: A. Issue a Writ, Order or direction in the nature of mandamus to the Respondent No.1 to grant of General parole to Convict Prisoner No.6961 Ramu S/o Rathnagiraiah for a period of 90 days. B. Pass such other orders/directions considering the facts and circumstances of the case together as to costs in the interest of justice. 2. The detenu had been convicted in S.C. No.487/2012 for the offences punishable under Sections 376(2)(g) read with Sections 149, 323, 324, 366, 427, 506(B) and 397 of the IPC by the IX Additional City Civil and Sessions Judge and FTC-2, Bengaluru City, and was sentenced on 06.09.2013, with the highest sentence being imprisonment for life. The detenu has served a period of 13 years 07 months 27 days of imprisonment as on 28.07.2026 and his conduct in - 3 - HC-KAR CNR: KAHC010565182026 NC: 2026:KHC:44878 WP No. 25784 of 2026 jail is said to be satisfactory. The detenu had earlier been granted court parole for a period of 15 days, pursuant to which he surrendered within the stipulated period. There was no complaint against the detenu during the period of parole, and his conduct continues to be satisfactory. 3. An application seeking grant of parole for the purpose of carrying out agricultural activities was rejected on the ground that the detenu’s brother is already engaged in agricultural activities and, therefore, there is no need for the detenu to be released on parole for the said purpose. 4. Considering that the detenu has been incarcerated for a period of 13 years, 7 months and 27 days, this Court is of the considered opinion that, in order to facilitate the detenu’s better reintegration into society upon release, he may be granted parole. As such, this Court passes the following: ORDER i. The Writ Petition is allowed. ii. Respondent–Chief Superintendent, Central Prison, Parappana Agrahara, Bangalore, is directed to release the detenu- Ramu (CTP No.6961) on parole for a period of 30 days commencing from 01.09.2026, subject to the following conditions: - 4 - HC-KAR CNR: KAHC010565182026 NC: 2026:KHC:44878 WP No. 25784 of 2026 a. The detenu shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take them to gaol, in the event, the detenu would evade going back to the gaol, after the expiry of the period of parole. b. Respondents shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to the gaol and that he shall not commit any other offence during the period of parole. iii. The Registry is directed to communicate the order to the prison authority for its immediate execution. iv.
