Chaitali Das Mr. Sharanya Chatterjee Mr. Subhajit Barman Ms. Riya Kundu ….for the petitioner This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 9th Court at Alipore to dispose of the Matrimonial Suit No.2405 of 2018 expeditiously. The learned advocate appearing for the petitioner submits that the no application for alimony pendente lite has been filed by the opposite party/wife. He further submits that no order has been passed in any proceeding directing the petitioner to pay alimony pendente lite or maintenance to the wife/opposite party herein. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocate representing the opposite party before the learned trial judge. The learned advocate appearing for the petitioner on instruction submits that on September 24, 2026 is fixed for further cross-examination of P.W.1. 2 In the light of the aforesaid submissions made by the learned advocate for the petitioner, CO 40 of 2025 stands disposed of by requesting the learned Additional District Judge, 9th Court at Alipore to take up the suit for further cross-examination of P.W.1 on the next date fixed i.e., on September 24, 2026 and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties keeping in mind that the matrimonial suit is pending from the year 2018. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
