The petitioner has filed the present writ petition seeking issuance of a writ of mandamus directing respondents 1 to 6 to take appropriate action for the 2/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.14192 of 2026 removal of the encroachment allegedly put up by respondents 7 and 8 in the Nilaviyal pathway comprised in Survey No.1189/1, which provides access to Arulmigu Nallamadasamy Temple, situated at Venkatachalapuram, Pirancheri Village, Manur Taluk, Tirunelveli District. 2. According to the petitioner, the entire extent of land in old Survey No.1189 originally belonged to Arulmigu Nallamadasamy Temple. Subsequently, the land was classified as Government Poramboke land, and in the remarks column of the revenue records, it was noted as belonging to Arulmigu Nallamadasamy Temple. During the UDR survey, the said land was subdivided into Survey Nos.1189/1 and 1189/2. Patta in respect of Survey No.1189/1 was thereafter issued in the names of private individuals. 3. The fourth respondent has filed a counter affidavit. 4. A perusal of the counter affidavit reveals that, as per the revenue records maintained under the Updation Registry (UDR) Scheme, the land measuring 1.76.00 hectares (4.34 acres) in Survey No.1189/1, situated in Pirancheri Village, has been classified as Ryot Punjai and stands registered in the 3/6 https://www.mhc.tn.gov.in/judis W.P(MD)No.14192 of 2026 names of Lakshmana Thevar and six others under Patta No.2355. The land measuring 0.05.00 hectares (13.58 cents) in Survey No.1189/2 has been classified as Government Poramboke and registered as “Kovil”. Further, the Field Measurement Book (FMB) and other documents relied upon by the petitioner do not indicate the existence of any cart track or pathway in the said survey field. Therefore, this Court finds no merit in the writ petition. If the petitioner has any subsisting grievance regarding the title or nature of the property, it is open to him to approach the competent Civil Court by instituting an appropriate civil suit. 5. Accordingly, the writ petition stands dismissed. No costs.
