The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.107 of 2026 of Jangareddygudem Police Station, Eluru District, registered against the Petitioner/Accused No.1 herein for the offence punishable under Sections 109(1), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Mr. Yennam Sudheer Babu, learned counsel for the petitioner, submits that the petitioner is innocent and that he has not committed any offence. He has been falsely implicated in this case. He is a law-abiding citizen. The learned counsel for the petitioner further submits that the petitioner has been in judicial custody for the past 95 days. All the accused, except the petitioner, have been enlarged on bail. Because of political rivalry, the petitioner has been implicated in this case. The petitioner would abide by any conditions that this Court deems fit to impose while enlarging him on bail. Hence, it is urged to enlarge the petitioner on bail. 3. Per contra, Ms. P. Akhila Naidu, learned Assistant Public Prosecutor, submits that the investigation is not completed. Some more material witnesses are to be examined. It is further submitted that the allegations

against Accused No.1 are severe in nature. The investigation is still pending. Hence, it is urged to dismiss the petition. 4. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 5. On a perusal of the record, this is the second bail application. A Coordinate Bench of this Court in Crl.P.No.3285 of 2026, vide order dated 29.04.2026, dismissed the first bail application.
In the remand report, the Investigating Officer has mentioned that nearly thirty cases were registered against the petitioner. The petitioner is a rowdy-sheet holder and a suspect- sheet holder. All the offences are either property offences or bodily offences. Some of them are excise offences. Some may include cheating offences. One offence relates to counterfeit currency and another relates to ‘the POCSO Act’. 6. Be that as it may, the Petitioner/Accused No.1 is presumed to be innocent until the guilt is proved. The Hon’ble Apex Court in Prabhakar Tewari v. State of Uttar Pradesh1, at para No.7, observed that mere pendency of criminal antecedents itself is not a ground to deny the request for grant of bail. 7. In the instant case, the investigation is still pending. Only eight witnesses have been examined. Some more material witnesses are yet to be examined. Therefore, the request of the petitioner for enlargement on

bail is not found to be convincing or reasonable at this juncture. Further, from the date of dismissal of the first bail application till the filing of the present second bail application, there is no change in circumstances with regard to the investigation. This Court does not find any merit in the case for grant of bail to the petitioner. Hence, this Criminal Petition is liable to be dismissed. 8. In the result, the Criminal Petition is dismissed.
