1. Writ petition is taken up for consideration in terms of order dated 4th August, 2026 in presence of learned advocates representing petitioner, respondent no.5 and State respondents.
2. Learned advocate representing State respondents has filed a communication dated 17th August, 2026 of Officer-in-Charge, Phoolbagan Police Station enclosing letter of petitioner dated 22nd May, 2026 and same are taken on record. Copies of the communication dated 17th August, 2026 along with copies of letter dated 22nd May, 2026 are made over to learned advocates representing petitioner and respondent no.5.
3. From letter issued by petitioner on 22nd May, 2026 in connection with Phoolbagan Police Station Case No.76 dated 11th May, 2026 it transpires that issue was
settled between the parties and it was admitted in said letter that petitioner received all medical stocks and all other articles. It the writ petition settlement of issue between parties and letter of petitioner dated 22nd May, 2026 issued in this regard are not disclosed.
4. It appears that there is suppression of material fact so far petitioner is concerned at the time of instituting this writ petition.
5. Hence, present writ petition stands dismissed.
