ORAL ORDER
1. Accused in S.C.No.1249 of 2019 pending before Court of LXII Additional City Civil & Sessions Judge, Bengaluru arising out of Crime No.46 of 2019 registered by Vidyaranyapura Police Station, Bengaluru City for offence punishable under Section 302 of IPC is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail.
2. Heard the learned counsel for the parties.

Perusal of the material on record would go to show that, the petitioner, who was earlier arrested in the present case was enlarged on regular bail by the Co-ordinates bench of this Court in Crl.P.No.7578 of 2019 disposed of on 07.02.2020. It appears that, subsequently, the petitioner had not appeared before the Trial Court on the regular dates of hearing. Therefore, steps were taken against him and his presence was secured before the Trial Court on 10.06.2026 and on the said day, he was remanded to judicial custody. His bail application filed thereafter before the Trial Court in Crl.Misc.No.6637 of

2026 was rejected on 10.07.2026. Therefore, he is before this Court.

Learned counsel for the petitioner has brought to the notice of this Court that in other criminal cases registered against the petitioner he has been already acquitted. Insofar as the present case is concerned, on merits he was earlier granted regular bail by the Coordinate bench of this Court in Crl.P.No.7578 of 2019 disposed of on 07.02.2020. Only for the reason that he had not appeared before the Trial Court on the regular dates of the hearing, petitioner was remanded to the judicial custody. He has undertaken to cooperate with the Trial Court for speedy disposal of the case. For the mistake committed by the petitioner, he has been substantially punished. Accordingly, the following:-
ORDER (i) Criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in S.C.No.1249 of 2019 pending before Court of LXII Additional City Civil & Sessions Judge, Bengaluru arising out of Crime No.46 of 2019 registered by

Vidyaranyapura Police Station, Bengaluru City for offence punishable under Section 302 of IPC, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
