Applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail as he is apprehending his arrest in connection with Crime No. 255 of 2026 registered at Police Station- Malkharuada, Outpost – Adbhar, District – Sakti (CG) for the offence punishable under Sections 296, 351 (3), 115 (2), 137 (2), 191 (2) of BNS, 2023 and under Section 67 (B) of the Information Technology Act, 200 and under Section 14 of the Protection of Children from Sexual Offences (POCSO) Act, 2012. The case of the prosecution, in brief, is that on 30.12.2025 at about 03:00 A.M., the Security Guard has made a complaint that since last many days from the southeastern part of the boundary wall, coal of the mines is being illegally transported. On the said date, he saw that one truck is being loaded with coal and after seeing the driver, he fled away along with the truck bearing registration no. CG 15 AC 4616 in which, coal weighing about 20- 25 tonnes was loaded. Based on the information, crime was registered against the driver of the Truck bearing registration no. CG 15 AC 4616. During the course of investigation, driver namely, Ramendra Yadav was arrested and on the basis of his memorandum statement, the applicant was also implicated as accused in the instant crime. 3. Learned counsel for applicant would submit that applicant is innocent, he has been falsely implicated in crime. He has not committed any offence as alleged. He submits that there is no direct evidence against the applicant. Applicant has not in any manner involved himself in commission of the aforementioned crime. There is no other criminal antecedent against the applicant. He is a Press Reporter and if the applicant is being arrested, he will loose his reputation in the society. Applicant is having no other criminal antecedents. 4. On the other hand, learned counsel for State opposes the submission of learned counsel for the applicant and would submit that in the memorandum statement, accused Ramendra Yadav have named the applicant that by his J.C.B., coal was loaded in the offending truck. 3 5. Upon putting specific query as to whether, the J.C.B. was driven by some other person or applicant, he submits that there is no such mention. 6. I have heard learned counsel for the parties and perused the documents placed on record. 7. Taking into consideration the facts and circumstances of the case, nature of allegations, submission of learned counsel for the respective parties, material collected by the police during the course of investigation, there is no other criminal antecedent against the applicant, without commenting anything on merits of the case, I am inclined to grant anticipatory bail to the applicant. 8. Accordingly, the application is allowed and it is directed that in the event of arrest of applicant in connection with the crime in question, he shall be released on anticipatory bail by the Officer arresting him on his executing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned arresting officer. Applicant shall also abide by the following conditions :- (i) that the applicant shall make himself available for interrogation before the Investigating Officer as and when required; (ii) the applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; Certified copy as per rules.
