JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused nos.1 to 6 in Crime No.149 of 2026 registered by Begur Police Station, Chamarajanagar District for offences punishable under Sections 352, 351(3), 108 R/w Section 3(5) BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the petitioners and learned HCGP for respondent - State. 3. FIR in Crime No.149 of 2026 was registered by Begur Police Station, Chamarajanagar District, against the petitioners herein, based on the first information dated 10.07.2026 received from Smt. Madamma, wife of deceased Guruswamegowda. Apprehending arrest in the said case, the petitioners had filed Crl.Misc.No.302 of 2026 and Crl.Misc.No.303 of 2026, which were dismissed on 05.08.2026. Therefore, they are before this Court. - 4 - HC-KAR CNR: KAHC010566402026 NC: 2026:KHC:44043 CRL.P No. 12475 of 2026 4. Perusal of the material on record would go to show that, the deceased and the petitioners are all close relatives and there is a dispute between them with regard to approach road in respect of property bearing survey No.83/1, 83/6 and 83/7 of Bhogaiahnahundi village. On 05.07.2026, the parties had quarrelled against each other in this background and it appears that, the deceased had therefore approached the police. On 10.07.2026, petitioners herein had once again confronted the deceased and abused him for having gone to the police station and also asked him to go and die. Subsequently, the deceased had committed suicide by hanging himself. 5. Considering the background in which the incident in question took place between the parties and also the nature of allegations found in the first information, I am of the opinion that, the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following:- - 5 - HC-KAR CNR: KAHC010566402026 NC: 2026:KHC:44043 CRL.P No. 12475 of 2026 ORDER (i) The Criminal Petition is allowed.
