ORAL ORDER
Petitioner-accused No.1 is alleged of the offence punishable under Section 103(1) of the BNS/302 of the IPC, inter alia. The petitioner seeks his enlargement on bail in C.C.No.225 of 2025 on filing of the charge sheet, for it having been turned down by the concerned Court, in terms of the
order dated 17-11-2025.
2. Heard Sri Gaurav Subramanya, learned counsel appearing for petitioner and Sri B N Jagadeesha, learned Additional State Public Prosecutor, appearing for the respondent.

The fulcrum of the allegation against the petitioner is, the petitioner and his friends including the deceased Kiran had been to “Sily” adda near Hullahalli circle, Nanjangudu to celebrate the birthday party of one Ravichandra. After the celebrations, they went to an Estate near Hejjige Bridge to consume alcohol and have dinner. After consumption of alcohol, it is said, on a squabble that arose between the petitioner and the son of the complainant one Kiran, petitioner along with his friends assaults Kiran and later during treatment, the said Kiran succumbs to the injuries sustained. Though initially while registering the crime the offence under Section 103(1) of the BNS was not alleged, but while filing the charge sheet, the said offence was added, as the deceased succumbs to the injuries in the hospital, at a later point in time.
4. In the teeth of the offence that is alleged against the petitioner, there is no warrant at this juncture to enlarge him on bail, notwithstanding the fact that charge sheet is filed and further proceedings are on.

5. However, reserving liberty to the petitioner to knock at the doors of the appropriate fora, in the event of any changed circumstance, the petition stands disposed.
