In this writ petition, the petitioner is assailing the
order dated 28.03.2011, produced as Annexure-G, and the order dated 31.10.2018, produced as Annexure-H, passed by respondent No. 2-Assistant Commissioner.

2. Heard Sri. Sharan N. Majage, Learned counsel appearing for the petitioner and Smt. Sharada H.V., Learned Additional Government Advocate appearing for the respondent-State.

Having heard the learned counsel appearing for the parties and upon careful consideration of the matter, it is evident that respondent No. 2-Assistant Commissioner initiated proceedings under Section 79- A and 79-B of the Karnataka Land Reforms Act, 1961 in which the petitioner did not appear before respondent No.2. Accordingly, an ex-parte order came to be passed.
4. In that view of the matter, taking into
consideration the fact that Sections 79-A and 79-B of the Karnataka Land Reforms Act,1961 have been repealed by way of amendment, and following the declaration of law made by this Court in W.P.No.12829

of 2023, disposed of on 01.04.2025, I am of the opinion that the writ petition deserves to be allowed. Accordingly, I pass the following:
ORDER i. The writ petition is allowed. ii. The order dated 28.03.2011, produced as Annexure-G, and the order dated 31.10.2018, produced as Annexure-H, passed by respondent No. 2-Assistant Commissioner, are hereby set aside. iii. Consequently, respondent No. 3-Tahsildar is
directed to enter the name of the petitioner in the revenue records forthwith.
