25.08.2026 Court No.35. D/L. 242. Kausik (Allowed) CRM (M) 1286 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kotwali Police Station Case No. 646 of 2025 dated June 05, 2025 under Sections 65(1) of the BNS read with Section 4 of the POCSO Act. And In the matter of : Gopal Sardar @ Gopal Pordar @ Bhola Sardar ……Petitioner. Mr. Navanil De Mr. Srinjan Ghosh ……for the Petitioner. Mr. Brajesh Jha, APP Mr. Ramashish Mukherjee ….for the State. Learned advocate appearing for the petitioner submits that the evidence of the victim is over. As such, the further custody of the petitioner, in the present circumstances, when further witnesses are to be examined by the prosecution, is unwarranted. State has produced the case diary. I have taken into account the statement of the victim under Section 183 of the BNSS. Victim refused medical examination. The evidence of the victim has been also placed before this Court. Petitioner is in custody for 1 year 2 months. 2 Having considered the overall circumstances and the fact that trial will consume some more time, I am inclined to release the petitioner on bail on stringent condition. As such, prayer for bail is allowed. Accordingly, Petitioner, namely, Gopal Sardar @ Gopal Pordar @ Bhola Sardar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Krishnanagar, Nadia. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Trial Court. Additionally, petitioner shall not enter the jurisdiction of Kotwali Police Station till the evidence of the vulnerable witnesses are over. Learned Trial Court would decide whether the evidence of all the vulnerable witnesses are over. On an appropriate application by the petitioner, at the relevant stage, Trial Court/Special Court would take a decision on the issue. With the aforesaid observations CRM (M) 1286 of 2026 is allowed. Memo of Evidence submitted be kept with the record. 3 Photostat copy of the evidence of the victim submitted by the petitioner be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
