No. 09 of 2012 whereby and whereunder the learned Court has dismissed the application dated 24.03.2025 filed on behalf of the petitioner/ plaintiffs for closing the evidence of P.W.-3 and not allowing the Opposite parties to cross examine the Plaintiff witnesses in view of the fact that the opposite parties have been debarred from filing the written statement.” 2. After some arguments, learned counsel for the petitioner seeks permission to withdraw the present CMP with a liberty to pursue his remedy in accordance with law by raising all the plea in the pending trial. 3. It has been submitted that the suit is of the year 2012 but the respondents are trying to delay the matter. 4. Without making any observation, it is expected that the Court below will proceed in the matter in right earnest and dispose of the pending suit as early as possible. 5.
