Mr. Avidit Noliyal, learned counsel for the petitioners, Mr. B.S. Adhikari, learned counsel for the respondent no.1 and Mr. Ashutosh Thakral, learned counsel for the respondent no.2 2. By the instant petition, the petitioners are praying for the following reliefs:- “i. issue an appropriate writ, order or direction to the Learned Civil Judge (S.D.) Haridwar to expedite the misc. case no. 58/2023 titled as Smt. Meena and others versus BHEL and others pending before the Learned Civil Judge (S.D.) Haridwar. ii. To Issue such other suitable writ, order or direction which this Hon'ble Court may deem fit and proper. iii To award cost of the writ petition to the petitioner.” 3. The reliefs, as sought, appears to be innocuous, whereby the petitioners are praying for grant of succession certificate and the proceedings are pending since 2023. 4. It is submitted by the learned counsel for the petitioners that the defendants are adopting the delaying tactics. 5. In such view of the matter, the writ petition is disposed of finally with the direction to the learned Civil Judge (Senior Division), Haridwar to expedite the Miscellaneous Case No.58 of 2023, titled as “Smt. Meena and Others vs. BHEL and Others”, as expeditiously as possible, preferably within a period of six weeks’ from the date of presentation of certified copy of this order. 6.
