JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No. 2 in S.C. No.141/2022 pending before the Court of III Additional District and Sessions Judge, Mysuru, arising out of Crime No.147/2021 registered by Saraswathipuram Police Station, Mysuru for the offences punishable under Sections 302 and 120(B) r/w. Section 34 of IPC, 1860 is before this Court, in this successive bail application filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. Perusal of the material on record would go to show that the petitioner had earlier approached this Court in Crl.P.No.12720/2024, which was dismissed by a reasoned order by a Co-ordinate Bench of this Court on 25.01.2025. The Co-ordinate Bench of this Court, having noted the - 3 - HC-KAR CNR: KAHC010474952026 NC: 2026:KHC:44950 CRL.P No. 10271 of 2026 gravity of allegations found against the petitioner, has refused to enlarge him on bail even though it had taken note of the fact that, he is in custody from 12.12.2021 and as on the said day, only 4 charge sheet witnesses were examined, out of the total charge sheet witnesses cited. 4. Learned counsel for the petitioner has brought to the notice of this Court that, thereafter, 14 charge sheet witnesses were examined and totally, as on this date, 18 charge sheet witnesses are examined as PW1 to PW18. 5. Learned HCGP submits that, if some reasonable time is granted, the remaining charge sheet witnesses will be examined expeditiously. 6. Considering the fact that the petitioner has no other criminal antecedents and is in custody for the last more than 4 ½ years and also having regard to the order passed by a Co-ordinate Bench of this Court, I am of the view that, if this petition is disposed of with a request to the Trial Court to expedite the trial and dispose of the - 4 - HC-KAR CNR: KAHC010474952026 NC: 2026:KHC:44950 CRL.P No. 10271 of 2026 main case itself, within a time-frame, the same would serve the ends of justice. Accordingly the following: ORDER The criminal petition is disposed of, with a request to the trial Court to expedite the trial in S.C.No.141/2022 and dispose of the main case within a period of six months from the date of receipt of a copy of this order, failing which, the petitioner is at liberty to file a fresh bail application before the Trial court seeking regular bail.
