Ms. Indrani Majumdar, Adv. …for respondent no.1 Ms. Pooja Sah, Adv. …for respondent no. 6 The Court: Affidavit of service and Notice of Motion are taken on record. The petitioner has preferred the present petition under Section 29A(4) of the Arbitration and Conciliation Act, 1996, seeking extension of the mandate of the Arbitral Tribunal for completion of the arbitral proceedings and publication of the arbitral award. Learned Counsel for the petitioner submits that this Court vide order dated 05.03.2020 had appointed Mr. Shyama Prasad Sarkar, Senior Advocate as the sole Arbitrator to adjudicate the disputes between the parties. Mr. Prasad held many meetings. However, he passed away on 2 27.07.2022. Thereafter, this Court appointed Mr. Suman Kumar Dutt, Advocate as the sole Arbitrator to adjudicate the disputes between the parties vide order dated 23.09.2022. Thereafter, this Court vide orders dated 07.02.2023, 10.01.2024, 07.08.2024, 06.02.2025 and lastly on 05.08.2025 extended the mandate of the Arbitral Tribunal by one year, six months, six months, six months and one year respectively. Learned Senior Counsel for the petitioner states that the mandate of the Arbitral Tribunal expired on 07.08.2026 and the matter is presently at the stage of arguments. Learned Counsel for the respondent states that he has no objection to the extension of the mandate of the Arbitral Tribunal. Upon consideration of the submissions of both the parties and the materials placed on record, this Court is satisfied that there has been no undue or unwarranted delay on the part of the learned sole Arbitrator in conducting the proceedings. Having regard to the advanced stage of the proceedings and in the interest of justice, the mandate of the learned sole Arbitrator is extended further for a period of eight months from today. The learned sole Arbitrator is requested to make all reasonable endeavours to conclude the arbitral proceedings and publish the arbitral award within the extended time period.
