Accused no.2 in Crime No.206/2018 registered by Ullal Police Station, Mangaluru City, for the offences punishable under Sections 143, 147, 148, 504, 506, 323, 324, 307, 149 IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.206/2018 was registered by Ullal Police Station, Mangaluru City, for the aforesaid offences against seven unknown persons based on the first information dated 12.10.2018 received from injured victim - Shreyas Shetty. In the said case, petitioner was arrested on 02.02.2019 and subsequently enlarged on bail. It appears that since the petitioner had not appeared before the committal court, thereafter a splitup case was registered against him and his presence was secured before the court on 10.06.2026 and on the said date, he was remanded to judicial custody. His bail application filed thereafter before the Sessions Court in Crl. - 3 - HC-KAR CNR: KAHC010517992026 NC: 2026:KHC:45633 CRL.P No. 11342 of 2026 Misc. No.561/2026 was rejected on 07.07.2026. Therefore, petitioner is before this Court. 4. It is not in dispute that on the merits of the case, petitioner who was arrested in this case was subsequently granted regular bail. Since the petitioner had not appeared before the committal court after the charge sheet was filed, a splitup case was registered against him and in the said case, he was arrested and remanded to judicial custody on 10.06.2026. 5. Learned HCGP has brought to the notice of this Court that after the year 2018, petitioner has not involved himself in any other criminal cases. 6. In the present case, for the mistake committed by the petitioner, he has been sufficiently punished and he is in custody for the last more than two months. Petitioner has undertaken to cooperate before the court for speedy disposal of the case. Considering the aforesaid aspects of the matter, I am of the opinion that petitioner's prayer for grant of regular bail is - 4 - HC-KAR CNR: KAHC010517992026 NC: 2026:KHC:45633 CRL.P No. 11342 of 2026 required to be answered affirmatively. Accordingly, the following order: 7. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.206/2018 registered by Ullal Police Station, Mangaluru City, for the offences punishable under Sections 143, 147, 148, 504, 506, 323, 324, 307, 149 IPC, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of - 5 - HC-KAR CNR: KAHC010517992026 NC: 2026:KHC:45633 CRL.P No. 11342 of 2026 the said Court until the case registered against him is disposed off.
