1. The petitioners pray for pre-arrest bail. They say that they have been falsely implicated. The victim has not suffered any grave injury. They will co-operate with the Investigating Officer.
2. Learned State counsel shows me the case diary. From the injury report I see that the victim did not suffer any significant injury.
3. On an overall
consideration of the
facts and circumstances of the case and the material-on-record, I am of the view that immediate custodial interrogation of the petitioners may not be necessary so long as they co- operate with the investigating officer.

Accordingly, in the event of arrest, the petitioners, namely Balen Roy, Bibek Roy, Depak Roy @ Dipak Roy and Rabi Roy shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that they shall meet the Investigating Officer of this case as and when called for.

In case the petitioners fail to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court.
6. The application for anticipatory bail, being CRM (A) 603 of 2026, stands disposed of.
7. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
