VENKAT CHALLA Counsel for the Respondent(S): 1. MANDA ADAM The Court made the following: THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI CIVIL REVISION PETITION NO: 2033/2016 ORDER: 1. This Civil Revision Petition, filed under Article 227 of the Constitution of India, is preferred by the petitioner/plaintiff, assailing the order dated 03.08.2015 passed by the learned I Additional Junior Civil Judge, Rajahmundry, (for short, ‘the Trial Court’), in I.A.No.1554 of 2014 in O.S.No.1291 of 2006. By the impugned order, the Trial Court dismissed the interlocutory application filed by the petitioner Under Order IV Rule 17 read with Section 151 of the Code of Civil Procedure, 1908 and Rule 28 of the Civil Rules of Practice, seeking amendment of plaint and consequential reliefs. 2. When the matter is taken up for hearing, learned counsel appearing for the petitioner submitted that the main suit in O.S.No.1291 of 2006 itself was dismissed by the Trial Court on 01.11.2024. He further contends that, in view of the dismissal of the main suit, the present Civil Revision Petition directed against the interlocutory order no longer survives for independent adjudication and has, therefore, become infructuous. 3. Recording the aforesaid submission, the Civil Revision Petition is dismissed as infructuous. There shall be no order as to costs.
