ORAL ORDER
1. Learned AGA accepts notice for respondents.
2. The petitioner-Detenu Prabhakar Anchan (CTP No.01611) is before this Court seeking for the following reliefs: a. Issue a Writ, Order or direction in the nature of mandamus to the Respondents for grant of general parole for 90 days for immediate medical treatment and take care of his wife. Further release the Petitioner on general parole as per Rule 191 of the Karnataka Prisons Rules.
b. To grant such other relief/s as this Hon'ble Court may deem fit in the circumstances of the case in the interest of justice.
3. The detenu had been convicted in S.C.No.96/2015 for offences under Section 302, 307, 324 and 323 of IPC by the IV Additional District and Sessions & Special Judge, D.K.Mangalore and sentenced on 15.07.2024 with the highest of the sentence being imprisonment for life. The detenu has served a period of 03 years 4 months 3 days of imprisonment as on 23.07.2026 and his conduct in jail is said to be satisfactory. The petitioner having made an

application for parole, the same came to be rejected on account of adverse report having received by the police.
4. The petitioner-detenu has been convicted for the offences punishable under Section 302, 307, 324 and 323 of IPC and has been sentenced to undergo imprisonment of life, the sentences being directed to run concurrently. As on date, the detenu has undergone only 03 years 4 months 3 days of the sentence imposed. In view thereof, I am of the considered opinion that this is not a fit case for grant of parole at this stage.
5. Reserving liberty to the petitioner to approach this Court after the detenu has undergone a substantial portion of the sentence imposed, the petition stands
disposed of.
6. In view of disposal of the main petition, pending IA's does not survive for consideration. Hence, IA stands
disposed of.
