Adv., Mr. Debanjan Das, Mr. Rajdeep Das ….for the State. 1. Learned Counsel for the petitioner has submitted that the petitioner is in custody for about 119 days. The investigation is complete. The petitioner has been falsely implicated in this case. There is no chance of an early conclusion of the trial. As the investigation is complete, he may be enlarged on bail on any condition. 2. The learned Counsel for the defacto complainant and the learned Counsel for the State oppose the prayer for bail. According to them, there are sufficient incriminating materials including the medical evidence against the present petitioner. Petitioner was aged about 2 twenty seven years at the relevant point of time and the victim was only nine years old minor girl. 3. I have gone through the material on record, it is true that the investigation is complete but there are sufficient incriminating materials against the present petitioner not only in the injury report but also in the Case Diary which shows that one independent witness saw the victim and the accused in the vicinity of the place of occurrence at the relevant point of time. 4. In view of the above materials on record I am not inclined to allow the prayer for bail at this stage. 5. The application for bail is, thus, rejected. 6. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. 7. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. (Apurba Sinha Ray, J.)
