Accused No.5 in Crime No.144/2026 registered by the H.D.Kote Police Station, Mysuru District, for the offences punishable under Sections 189(2), 352, 118(1), 109(1), 351(3) read with Section 190 of the BNS, 2023, is before this Court in this petition filed under Section 483 of the BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.144/2026 was registered by H.D.Kote Police Station, Mysuru District, for the aforesaid offences against Kendagannaswamy and others based on the first information dated 12.06.2026 received from Basappa, who is one of the injured victim in the present case. During the course of investigation, the petitioner was arrested on 13.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in - 3 - HC-KAR CNR: KAHC010481662026 NC: 2026:KHC:43808 CRL.P No. 10433 of 2026 Crl.Misc.No.945/2026 was rejected on 08.07.2026. Therefore, he is before this Court. 4. A perusal of the material on record would go to show that the family of the petitioner and the family of the first informant are residing in adjacent houses. It appears that the son of the first informant is constructing a house and there is a dispute between the two family members with regard to the said construction, which is being put up by Ashoka, son of the first informant. It is under these circumstances, the parties had fought against each other on 12.06.2026 at about 7.20 pm. 5. Allegation of assaulting the victims with weapons is found against accused Nos.1 and 2 in the FIR. So far as accused Nos.3, 4 and 5 are concerned, it is alleged that they had pushed the first informant and as a result, he had fallen to the ground. There is no allegation as against accused Nos.3 to 5 about they assaulting the victims with any weapons. 6. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of - 4 - HC-KAR CNR: KAHC010481662026 NC: 2026:KHC:43808 CRL.P No. 10433 of 2026 regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following: ORDER The criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.144/2026 registered by the H.D.Kote Police Station, Mysuru District, for the offences punishable under Sections 189(2), 352, 118(1), 109(1), 351(3) read with Section 190 of the BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. - 5 - HC-KAR CNR: KAHC010481662026 NC: 2026:KHC:43808 CRL.P No. 10433 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed of.
