THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE E.S.INDIRESH ORAL ORDER 1. In this Writ Petition, petitioners are assailing the order dated 23.07.2025 in RP No.291/2024 (Annexure-J) on the file of the respondent No.1. 2. It is contended by the learned counsel appearing for the petitioners, that though the matter has been remanded to respondent No.2, however, the finding that has been recorded by respondent No.1 would not influence in so far as the remaining extent of land of the private respondents is concerned and accordingly sought for interference of this Court. - 6 - HC-KAR CNR: KAHC010742202025 NC: 2026:KHC:44257 WP No. 34616 of 2025 3. Per contra, Rajaram S., learned counsel appearing for the respondent Nos.4 to 11, sought to justify the impugned order in so far as remanding the matter to the authority and submitted that, as katha has been made in respect of the actual possession of the land in question and where the material on record has not been properly assessed by the respondent No.2 while passing the order at Annexure-F, accordingly, sought to justify the impugned order. 4. In the light of the submission made by the learned counsel for the parties, as the matter requires to be reconsidered by the respondent No. 2, on the sole ground, that the respondent No. 2 ought to have considered the documents produced by the petitioner as well as the respondent No.1 and that apart, the perusal of the impugned order at Annexure-J would indicate that the actual possession of the land in question has been considered for the purpose of entering the name of the parties in the khata in respect of the subject land. In that view of the matter, I do not find any merit in the Writ Petition. As the matter has been remanded to respondent No.2, - 7 - HC-KAR CNR: KAHC010742202025 NC: 2026:KHC:44257 WP No. 34616 of 2025 I am of the view that no interference is called for in this Writ Petition. 5. Accordingly, the Writ Petition is dismissed. 6. Since the parties are represented through their learned counsels, parties are directed to appear before respondent No.2 on 21.09.2026. 7. Till the conclusion of the proceedings before respondent No.2, status-quo as on today with regard to entry in the revenue records in respect of the subject land shall be maintained.
