Learned counsel for respondents submits that there is an appeal provision provided under Section 61 of the Companies Act, before the National Company Law Appellate Tribunal. 3. Learned counsel for the petitioners seeks liberty to avail such remedy. He seeks for a direction to consider the time consumed in prosecuting the present petition, for the purpose of condonation of delay. 4. Since alternative statutory remedy is provided, petitioners are at liberty to avail the same if so advised. If such an appeal is filed, time consumed in prosecuting the present petition may be considered for the purpose of condonation of delay, subject to all just exceptions. 5.
