JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court, seeking the following prayers: "a) Pleased to quash the FIR registered by Nelamangala rural police Station at Nelamangala, Bengaluru rural District for the Offence Punishable under Section u/s 316(2), 316(5), 318(4), 351(2), 352 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, in Cr No. 182/2026 as per ANNEXURE-A and the same is pending before same is pending on the file Prl. Civil Judge (Jr.Dn) & JMFC Court at Nelamangala, Bengaluru rural District in the interest of justice and equity. b) Pass such other order or orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice and equity." 2. The issue in the lis is with regard to certain transactions of the complainant depositing money into the accounts of accused Nos.1, 2 and 3. The petitioner is accused - 3 - HC-KAR CNR: KAHC010492542026 NC: 2026:KHC:44769 CRL.P No. 10779 of 2026 No.1 - the Manager working in a branch of the State Bank of India. 3. The issue is not that the complainant has deposited the amount into the account of the Bank for it to be a loan. A cheque is issued to the petitioner - accused No.1 by the complainant for a sum of Rs.10,00,000/-, which is deposited and encashed by the petitioner. It is then the complaint emerges that it is a ploy of accused Nos.1, 2 and 3 that they would secure loan from the hands of State Bank of India for which this amount would be a commission. 4. In that light, the issue needs investigation in the lis. Therefore, reserving liberty to the petitioner to re-approach this Court, if the final report is filed and the final report would go against him, the criminal petition stands disposed.
