No. 32 situated at Kainoor Village, Arakkonam Taluk. ORDER By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
2. The present writ petition has been filed praying for a writ of Mandamus, to direct the respondents to consider and pass orders on the petitioner’s representation dated 07.04.2026 seeking to construct Limited Use https://www.mhc.tn.gov.in/judis
WP No. 21638 of 2026 __________ Page3 of 6 subway without affecting 23 feet main approach road and 14 feet connecting road to the petitioner property as specified in the DTCP and RERA approval granted to the petitioner’s plots before proceeding with the construction of Limited use Subway at L.C. No. 32 situated at Kainoor Village, Arakkonam Taluk.
3. At the outset, the learned counsel appearing for the respondents would submit that petitioner's representation dated 07.04.2026 would be considered and appropriate orders would be passed after issuing notice to petitioner and any other interested parties, within a time period to be stipulated by this Court. Agreed to by the learned counsel for petitioner.
4. In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the respondents to consider the representation dated 07.04.2026, on its own merits and pass appropriate orders in accordance with law, after issuing notice and after affording reasonable opportunity of hearing to petitioner, and any other interested persons within a period of four (4) weeks from the date of uploading of web copy without waiting for receipt of certified copy of the order.
