1. Since the aforesaid bail applications arise out of same crime number, they are being disposed of by this common order. 2. These are the first bail applications filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who have been arrested in connection with Crime No.155/2026 registered at Police Station : Tarbahar, District Bilaspur (C.G.) for the offence under Sections 318 (4), 112, 3(5) & 317 (4) of the BNS. 3. The prosecution case, in brief, is that the concerned Police is investigating an offence related to monetary transactions through alleged 'mule accounts'. According to the prosecution, co-accused Deepesh Gupta, Navneet Mishra, and Raja were previously known to accused Rishabh Sahu. The prosecution has no evidence to prove that the said accused received any financial benefit, operated any account, or that his role was anything more than highly limited and peripheral in nature. There is also no allegation in the case that any amount obtained from the alleged offence was deposited into the accused’s account or that any financial gain was earned by him. According to the prosecution, on 13.05.2026 at around 15:10 hours, a police team acting on a tip-off from an informant apprehended a co-accused named Dipesh Kumar Gupta near the State Bank of India, Vyapar Vihar, Bilaspur. It was alleged that he was alluring passersby to share their bank account details in exchange for a commission.
Upon searching the co-accused Dipesh Kumar Gupta, a Samsung mobile phone was seized. On checking his WhatsApp chats, various bank account numbers were found exchanged with individuals named Vicky Pandit, Shubham Patel, Ayush, Aamir, and Almas. The prosecution alleges that
3 co-accused persons were running an organized racket operating "mule accounts" to facilitate cyber fraud and financial laundering. During the probe, the name of the accused surfaced. Thereafter FIR was registered against the applicants. Hence the bail application. 4. It has been argued by learned counsel for the applicants that the applicants are innocent and have been falsely implicated in the crime. Applicants have no criminal antecedents. Co-accused have already been released on anticipatory bail vide order dated 23.7.2026 passed in MCRCA No.859/2026, and regular bail vide order dated 10.08.2026 passed in MCRC/4974/2026, MCRC /6813/2026 & MCRC/5809/2026. Charge sheet has already been filed. They are in jail since 16.05.2026 & 03.07.2026, respectively, therefore, the applicants may be released on bail. 5. On the other hand, learned counsel appearing for the State/non- applicant would oppose the submissions made by counsel for the applicants. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Taking into consideration the facts and circumstances of the case and the fact that the charge sheet has already been submitted against the applicants; the applicants have no criminal antecedents; co-accused have already been released on anticipatory bail and regular bail by this Court vide orders dated 23.7.2026 & 10.08.2026, respectively; they are in jail since 16.05.2026 & 03.07.2026, respectively, and conclusion of trial is likely to take some time, this Court is of the view that the applicants are entitled to be released on bail in the present case. Accordingly, the Applications are allowed. 8.
Accordingly, the Applications are allowed. 8. It is directed that in the event of the applicants executing their personal bond for a sum of Rs.50,000/- each with one surety in the like sum to the satisfaction of the concerned trial Court, they shall be
4 released on bail on the following conditions:- (i) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court; (ii) they shall not act in any manner which will be prejudicial to fair and expeditious trial, & (iii) they shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial.
