The petitioner has assailed the notice of the meeting primarily on the ground that clear seven day’s notice was not issued upon her in terms of Section 12(3) of the West Bengal Panchayat Act, 1973. At this stage, learned counsel for the private respondents seeks to submit a fresh motion on the same cause of action before the Prescribed Authority. On prayer of the private respondents, liberty is granted to submit a fresh motion before the Prescribed Authority in terms of Section 12 of the Act of 1973. On receipt of such motion, the Prescribed Authority shall take necessary steps in accordance with the said provision of law particularly, the time frame stipulated therein. 2 In view of the above, the motion dated 13th July, 2026 and the notice of meeting issued on 15th July, 2026 are set aside/quashed. Nothing further remains to be dealt with in the writ petition. The same is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
